(1) When a case is filed under this Act, it shall not be filed without the approval of the Government of Nepal or the official appointed by the Government of Nepal by publishing a notice in the Nepal Gazette. If a petty shopkeeper commits an offense under section 3, 4 and 5, after looking at the nature of the offense, if it is a first-time offense, the officer under sub-section (1) should file the wrongfully taken profit and file a document stating that he will not commit such an offense again, and keep him in custody. (3) The case under this Act must be filed within 90 days after the crime has been committed or discovered.
